LATEX BALLOON WARNING: CHOKING HAZARD 

Children under 8 years can choke or suffocate on uninflated or broken balloons. Adult supervision is required.  Keep uninflated balloons away from children. Discard broken balloons immediately. 

LATEX BALLOON WARNING: ALLERGEN HAZARD

Balloons used in balloon decor installations contain Natural Rubber Latex which may cause Allergic Reactions.

FOIL BALLOON WARNING: ELECTRICITY CONDUCTOR

Foil/Mylar balloons though festive are dangerous around power lines. Their silvery metallic coating is a conductor of electricity. When mylar balloons float into the air and make contact with power lines, they can short transformers, cause power outages, melt an electrical wire and cause it to fall.


Balloon Care Disclaimer

KReative Gig is not liable for balloons once they are out of our care. We use only the highest quality balloons and materials, however, some balloons may pop or deflate or be compromised sooner than anticipated. We cannot guarantee your balloons will last once they have been delivered, installed, or picked up. Environmental factors, including weather, children, pets, different surfaces, hot or cluttered car conditions, and foliage can jeopardize the lifespan of our creations. We will replace anything we pop in transportation or during setup. If it has been worked into your specific contract to have a KReative Gig staff member onsite throughout your event, they will tend to the balloons as reasonably possible, and for only certain types of installations, throughout the time they are scheduled at the event. 

Artistry Expectations

Every arrangement is a one-of-a-kind creation. KReative Gig collaborates with every client; taking their preferences and Balloonistry realities to create a piece of art! Shades and colors are subjective; what looks "Teal" in some eyes may differ from others. KReative Gig relies on current and available stock of non-defective balloons/items. We will try our best to make a predictable outcome, but as the artists, we reserve the right to make necessary changes during the creative process.

Material Guarantee

All materials are guaranteed to be as specified by the manufacturer. If a supplier discontinues a product or manufacturer changes material type, ADP reserves the right to make any last-minute changes (at our discretion based on the availability of materials at the time of the event). We reserve the right to substitute an item of like kind and quality.  

Disclaimer

Disclaimer: We use professional equipment and material as intended for its particular purpose within all designs. To limit your risk of damage we recommend that all decor and items remain in the position and location they are ordered for, installed in, or placed in. Please do not use or place any decor designed for indoor use outdoor or outside of covered 4-wall framed structures without a cieling.  

Pricing Guide Disclaimer

KReative Gig Balloon Services have a pricing guide of charging per cubic foot of garlands made out of latex balloons. Factors that change the price of the per cubic pricing that KReative Gig uses include, but are not limited to: accessory/foil balloons, the complexity of design, scope of detail work, location/placement of garland, inflation, shipping, price changes/availability of materials in the market, etc... 


Booking

An event is ONLY considered "booked" after payment (deposit or total amount) is made by the due date indicated on the service invoice. If the Client allows quotes/invoices to expire, it is understood that the event date and time will be made available to other clients, and any discount or special promotion applied MAY be removed and invalid. 

Installations

The Creative Director overseeing the installation should receive any permits, access passes, gate/room access cards, wrist bands, etc, 24 hours prior to the date of installation to ensure access to the venue. If access is denied at any time, for any reason, including failure or lack of communication, it will result in items not being installed punctually or adequately, and possibly not at all. If this occurs, the Client agrees that KReative Gig will not be held liable.

Installation Fee is minimum 25% of Installment

• All installations require a minimum of 2 (two) hours for orders totaling $150-$450.

• All installations require a minimum of 3-4 (three-four) hours for orders of $450-$650.

• All installations require a minimum of 4-5 (four-five) hours for orders $651+.

If any orders are of intricate detail, large capacity, or for any other reason that requires more than 4 hours for installations, they will be documented and adhered to in order to receive a quality installation. The time designated for the installation will be utilized, however, any time left over after installation is complete is not subject to discounts or refunds. 

On-Site Changes

Our mission is to make you and our balloons look great. If we cannot complete the decor as designed and planned due to unforeseeable circumstances at the event venue or client preference. In that case, we will assess a change fee if we incur any additional labor or material expense due to such changes. 

Venue

The Client is responsible for seeing that the venue has the name of the Creative Director’s name and contact number on file for two reasons; 1) The Creative Director needs to have a point of contact at the venue in the event a change has occurred on our end, we have a way to relay that info, possibly find a resolution if applicable. 2) In the event the point of contact at the venue needs to reach the Creative Director to inform BB of a change, it makes the communication process easier. This also allows for the Client to not be inconvenienced on the day of installation as well.

Rules and regulations of all event sites are the responsibility of the Client. The Client shall provide a copy of all pertinent rules to us before securing our services. It is the Client’s sole responsibility to confirm if the venue allows; helium tanks, helium balloons, Balloon Shine products solution, tall structures, wall hangings, tall ladders, etc. prior to any payment made to KReative Gig. If the Client fails to confirm the venue’s rules for balloons, helium tanks/balloons, wall hangings, tall ladders, etc. prior to making any payment(s), said payment(s) will be forfeited and considered non-refundable.   

It is the Client’s responsibility to make arrangements for KReative Gig to gain/maintain access to the venue. The Client is also responsible for obtaining any permits, access passes, gate/room access cards, and wristbands for the entire staff, as well as notifying KReative Gig of any room changes within the venue, if applicable, within at least 24 hours notice. Access arrangements apply to access prior to the event for installation, as well as access to strike, if applicable, or breakdown of any props, designs, equipment, etc. If props/designs/equipment is transported by the Client, the Client may return said items to KReative Gig the following day. 

Personal Residence

If the location of the event is located in a personal residence, the installation times still apply. The access requirements are still applicable in regards to allowing KReative and its Creative Director and teams access to make the installation. The Client understands that installations are done using an array of options including but not limited to command strips, removable wall mounts, etc. If there is a preference in a method of installation, please inform your Creative Director when signing the Terms & Conditions as it will need to be documented in the invoice. 

• All installations require a minimum of 2 (two) hours for orders totaling $150-$450.

• All installations require a minimum of 4-5 (four-five) hours for orders $651+.

Delivery/Set-Up/Pick up

Access to the event location must be secured and confirmed by the Client to ensure timely setup. KReative Gig cannot be held responsible for delays (or incomplete décor) if a reasonable amount of time is not allowed to complete delivery/setup services. Delivery to additional locations (i.e., hotel/home/church, etc.) not mentioned in the order will incur additional delivery and setup fees. In the event of setup or pickup delays caused by such parties as but not limited to the caterer, baker, venue, DJ, band, and wedding party, a minimal additional fee of $30.00 per -hour per onsite KReative Gig staff member will be charged.

Delivery of Rental(s)

Lessee shall be present onsite during delivery and installation to personally inspected the rented property to find it to be in good working and unbroken condition when received.
 It is the Lessee's sole responsibility to ensure the event space is suitable and appropriate for safe delivery and installation of all Rental/s. If the event venue has more than 4 exterior or interior steps, no access ramp or accessible elevator, and the event space is not on the main floor please tell us. It affects the scheduling, the number of crew members assigned to the delivery, and possible pricing. Refunds MAY NOT be granted on rentals whether used or not once they have left our warehouse. 

Loss & Damage

 If the Rental/s are lost, stolen, or damaged, Lessee will pay KReative Gig the current market cost to replace or repair any Rental/s lost, stolen, or damaged. The Lessee will be responsible for loss of, or damage to the Rental/s caused by reckless, careless, or abusive operation or use of the Equipment and loss or damage caused by dishonesty of event guest, venue staff, or any person who is present at the time damage or loss occurs. Any damages done to the Rental/s during the party will be charged to the Lessee, damages including but not limited to breaking, holes, stains from food or clothing, and chips in the paint. Any deposit or credit card pre-authorization will immediately be applied towards the full replacement or repair value of any damaged, lost, or stolen Equipment.  

Disclaimer of Warranties

KReative Gig makes no warranty of any kind, either express or implied, as to the condition of or performance of any leased equipment and the Lessee agrees to immediately cease use of the equipment and contact KReative Gig if any of the leased equipment develops any indication defect or improper working conditions. Lessee agrees to use the equipment at Lessees' own risk.  

Refund/Cancellation Policy

The client is allowed to cancel at any time before the delivery or event date. However, a cancellation fee will apply. Refunds must be requested in writing by email ONLY and will be processed within 7 days from the time of receipt of the request. Full refunds MAY NOT be given, it is on case-by-case bases, if the refund request falls within 14 days. 

Cancellation fee is $50 unless stated on first page of The Balloonary: Service Agreement, Terms and Conditions, distributed by KReative Gig.

Refunds will be calculated based on items purchased specifically for your event (including but not limited to custom balloons or accessories if applicable) as well as accumulated time invested in your event.

Pricing & Fees

All pricing regarding the entire order including but not limited to, delivery fee, installation fee, set down fee, cancellation fee, etc. will be documented during the booking stage. All payments made towards any and all of these charges are non-refundable. 


All payments must be made according to the stated payment schedule. 30% of the invoice total is required as a deposit. The full invoice payment must be made with the balance due at least three (3) days before the event delivery/setup date.

Failure to make payments by the due date or on time may result in any or all of the following: 

 


Service Retainer

Upfront non-refundable payment to secure services and block anyone from initially booking your slot. The service retainer is applied to the final balance and not billed as an additional cost. 

Service retainers include a total of 4 planning hours which include: your initial consultation, research, proposals and paperwork, revisions, conversations via email/text/voice, meetings, other design, and event planning methods. Additional planning time will be charged $30/hr including travel time. KReative Gig reserves the right to waive any fee and add additional consultation time for larger events or deemed necessary by KReative Gig.

$90 non-refundable fee; if and once applied. Not all contracts involve a service retainer.

Site Visits if deemed required by KReative Gig and the Client will be included in the $90 service retainer unless travel time exceeds 40 mins one way.

Deposit

A payment that goes towards goods and services. Deposits are applied to the final balance and not billed as an additional cost.

Deposits are 30% of the total installment price per event. The final amount is due at least 3 business days before the event/installment/pick up. 

Delivery

Our delivery fee depends on the location, complexity and how many trips are required. We are based out of San Jose, CA, 95125. 

Striking

The strike charge is when we return to retrieve our equipment and clean up after the event, this is not always needed depending on your order and venue location. 

Returning to pick up equipment and not cleanup has different pricing determinations based on location.

Outdoor Installations

A 40% markup applies to each outdoor installment.  This fee covers the extra expense to use only outdoor prepped balloons (double stuffing each balloon is required) which will lessen, but not eliminate, the chance of balloons popping due to being exposed to the elements.

On hot days, in direct sunlight, balloons may pop within an hour. The same result can occur indoors if balloons are exposed to direct sunlight through windows. Clients assume all risks involving balloon decor popping for outdoor installations, even when not placed in direct sunlight.

We use only the highest quality products and techniques to build your décor. However, due to the general nature of balloons, we cannot guarantee that balloons will remain perfect and intact when used outdoors. Most outdoor decor is still subject to popping, “frosting” or fogging/oxidation of the colors, and/or movement from the wind. If inclement weather conditions make it difficult or impossible to produce as specified Kreative Gig will do its best to be flexible with providing decor alternatives. It is clearly understood that there will be no refunds or discounts for loss, breakage or failure to produce due to factors outside and beyond our control. 

If KReative Gig staff was hired to maintain installments at an event they will do their reasonably best in replenishing decor safely and at an appropriate time. Not all installments qualify for maintenance by hired KReative Gig staff during events.

KReative Gig will not be held liable for the reaction of any balloon decor to the weather or uncontrollable acts of nature including but not limited to rain, wind, or extreme heat. KReative Gig NEVER guarantees perfect results for any installation done outdoors or in these uncontrollable situations.
